Terms and Conditions

These Terms and Conditions govern the supply of products and services by Everflow Filtration ("Everflow Filtration", "we", "us", or "our") to the Customer.


1. Definitions

1.1 Customer refers to any individual, business, or entity purchasing goods or services from Everflow Filtration, including any person acting with authority on behalf of that individual or entity, as identified in any quotation, invoice, work authorisation, contract, or order document.

1.2 Company means Everflow Filtration Pty Ltd.

1.3 Goods means all products supplied by Everflow Filtration, including filtration systems, components, accessories, and related equipment, as detailed in quotations, invoices, agreements, or order forms.

1.4 Services refers to any labour, installation, maintenance, testing, or related services performed by Everflow Filtration in connection with the supply of Goods.

1.5 Price means the amount payable by the Customer for Goods and/or Services, as agreed between the Customer and Everflow Filtration.


2. Australian Consumer Law Compliance

2.1 Nothing in these Terms and Conditions is intended to exclude, restrict, or modify any rights or remedies available under the Competition and Consumer Act 2010 (Cth), including the Australian Consumer Law (ACL), or any applicable Fair Trading legislation.


3. Acceptance of Terms

3.1 By placing an order, signing an agreement, or accepting delivery of Goods or Services, the Customer confirms acceptance of these Terms and Conditions.

3.2 Where multiple parties are listed as Customers, each party will be jointly and individually responsible for payment obligations.

3.3 These Terms remain binding once accepted and may only be modified with written approval from Everflow Filtration.

3.4 Everflow Filtration may engage qualified third-party contractors to complete installation work. These contractors are independently insured and responsible for their own workmanship.

3.5 If concerns arise regarding contractor performance or conduct, the Customer agrees to attempt resolution with the contractor before escalating the matter to Everflow Filtration.

3.6 Everflow Filtration reserves the right to substitute equivalent components if necessary, provided the Customer is notified beforehand.

3.7 Installation dates may be changed with at least 48 hours' notice. Changes made with less notice may incur a reasonable rescheduling fee.


4. Pricing and Payment

4.1 The Price payable shall be:

  • The amount stated on the invoice, or 
  • The quoted amount provided in writing, or 
  • The current price applicable at the time of delivery 

4.2 Prices may be adjusted where:

  • The Customer requests changes to specifications 
  • Costs of labour, materials, shipping, or taxes increase 
  • Additional costs arise due to unforeseen site conditions 

4.3 Everflow Filtration may require a deposit prior to commencing work.

4.4 Payment terms will be stated on invoices. If no payment period is specified, payment is due within 7 days from the invoice date.

4.5 Accepted payment methods may include:

  • Bank transfer 
  • Credit or debit card 
  • Cash 
  • Other agreed payment methods 

4.6 Credit card payments may incur a processing surcharge.

4.7 GST and other applicable taxes will be added where required unless already included in the quoted price.


5. Delivery and Installation

5.1 Delivery is considered complete when:

  • Goods are collected by the Customer 
  • Goods are delivered to the Customer's nominated address 
  • Goods are installed at the nominated premises 

5.2 Delivery fees may apply depending on the delivery location and order details.

5.3 The Customer must ensure delivery access is available at the agreed time.

5.4 Installation timelines may be extended where delays occur due to factors beyond Everflow Filtration's control, including:

  • Customer delays 
  • Site access restrictions 
  • Material shortages 
  • Weather events 
  • Regulatory approvals 
  • Labour shortages 
  • Unexpected structural or plumbing conditions 

5.5 Everflow Filtration is not liable for delays caused by external circumstances.


6. Customer Responsibilities and Acknowledgements

6.1 The Customer acknowledges that filtration performance depends on various factors, including:

  • Source water quality 
  • Plumbing infrastructure 
  • Environmental conditions 

6.2 The Customer agrees that any general product descriptions or marketing materials are indicative only.

6.3 Unless confirmed in writing, Everflow Filtration does not guarantee suitability of products for specific purposes.

6.4 The Customer confirms reliance on their own judgment when selecting Goods.


7. Installation Requirements

7.1 The Customer confirms that:

  • Installation locations are structurally suitable 
  • Plumbing connections meet required standards 
  • The premises are safe and accessible 

7.2 If unsafe conditions are identified, installation may be delayed until risks are resolved.

7.3 Any additional work required to meet safety or installation requirements will be treated as a variation and may incur additional costs.


8. Site Access

8.1 The Customer must provide safe and unobstructed access to the installation area.

8.2 Everflow Filtration is not responsible for minor site disturbances unless caused by negligence.


9. Ownership and Risk

9.1 Risk in the Goods transfers to the Customer upon delivery or installation completion.

9.2 Ownership of Goods remains with Everflow Filtration until full payment is received.

9.3 Until ownership transfers, the Customer must:

  • Maintain Goods in good condition 
  • Not sell or transfer ownership 
  • Allow recovery of Goods if payment obligations are not met 

10. Inspection and Defects

10.1 Customers must inspect Goods upon delivery.

10.2 Any defects or damage must be reported within 3 days.

10.3 If defects are confirmed, Everflow Filtration may repair or replace Goods at its discretion, subject to consumer law rights.


11. Warranty

11.1 Everflow Filtration provides the following warranties:

  • Whole home filtration systems — 24 months warranty 
  • Under-sink reverse osmosis systems — 12 months warranty 

11.2 Warranty coverage excludes damage caused by:

  • Improper use 
  • Lack of maintenance 
  • Unauthorized modifications 
  • Environmental conditions 
  • Normal wear and tear 

11.3 Installation must be completed by licensed plumbers to maintain warranty validity.

11.4 This warranty operates in addition to rights under Australian Consumer Law.

Customers must provide:

  • Purchase details 
  • Description of issue 
  • Supporting photos where available 

12. Default and Non-Payment

12.1 Interest may apply to overdue payments at a reasonable rate permitted by law.

12.2 Customers are responsible for any dishonour or debt recovery costs.

12.3 Everflow Filtration may suspend supply if payment obligations are not met.

12.4 Outstanding balances may become immediately payable if the Customer becomes insolvent.


13. Cancellation Policy

13.1 Everflow Filtration may cancel an order prior to delivery by issuing written notice and refunding payments received.

13.2 Customer cancellations may result in charges to cover costs incurred before cancellation.

13.3 Custom or special-order products cannot be cancelled once production begins.


14. Refund Policy

14.1 Refunds, repairs, and replacements are provided in accordance with Australian Consumer Law.

14.2 Refunds are generally not provided for change-of-mind purchases.

14.3 Deposits may be refunded where installation cannot proceed due to factors beyond both parties' control.


15. Referral Program Terms (Optional — if you plan to run one)

15.1 Everflow Filtration may operate referral programs from time to time.

15.2 Referral rewards may be offered when:

  • A new customer is introduced 
  • The referred customer purchases and installs a qualifying system 
  • Payment has been completed 

15.3 Rewards are issued after installation and full payment.

15.4 Everflow Filtration reserves the right to modify or discontinue referral programs at any time.


16. Promotional Offers

16.1 Promotional discounts may be offered periodically.

16.2 All promotional offers:

  • Are subject to availability 
  • Cannot be combined with other offers unless specified 
  • May be withdrawn at any time 

16.3 Additional installation costs may apply where installations fall outside standard installation conditions.


17. Limitation of Liability

17.1 Everflow Filtration is not liable for indirect or consequential losses, including loss of profits.

17.2 Liability for breach of contract will not exceed the total Price paid for the Goods or Services.


18. General Provisions

18.1 If any clause is found invalid, remaining clauses remain enforceable.

18.2 These Terms are governed by the laws of Victoria, Australia.

18.3 Everflow Filtration may subcontract services without prior notice.

18.4 Failure to enforce a clause does not waive the right to enforce it later.

18.5 Neither party is responsible for failure to perform due to events beyond reasonable control, including:

  • Natural disasters 
  • Government restrictions 
  • Industrial action 
  • Supply chain disruptions
